Businesses’ datafication and the protection of personal data

The increasing displacement of human activities and instances from a physical to a virtual domain brought some concern and issues in relation to this process. Given current times where physical activities have been limited by the COVID-19 outbreak, the digitization of businesses has accelerated its course. Such digitization inevitably delivered new concerns especially in relation with personal data; which have been acknowledged by the General Data Protection Regulation (GDPR) in 2016; the year of its entry into force.

Personal data are all that set of information that may identify an individual or make it identifiable. This means that when interacting with digital services providers, individuals leave digital trace of their online activities. This means that digital service providers must comply with a strict rules that define principles, manners, and requirements for a lawful data processing. In fact, sanctions and penalties in relation to unfair or unlawful data processing are high.

Within this context, it is paramount to understand duties, accountabilities and principles connected to data processing. Again, data controller and processor must be familiar with concepts such as Data Breach or Data Privacy Impact Assessment. Additionally, drafting a clear, transparent, and effective Privacy Notice just became a fundamental aspect of digitised businesses.
