Airbnb is the online property rental marketplace that allow hosts to rent out short-term private accommodation including single rooms or entire property. Since its entrance in the market, Airbnb rapidly grown to include listings for over three million properties in more than sixty five thousand cities. Italian Government has proposed a Draft Law regulating short-term rental agreements. The Draft Law promotes new touristic measures under the umbrella of consumer protection and competition law. In particular, short-term rental business grown to the detriment of professional and authorised private entities such as B&B, hotels, and other hospitality model: which were subject to corporate taxation and other burdens.
With the purpose of protecting previous touristic operators, a rental threshold has been proposed. In particular, any rental business that include over three properties will be qualified as business activity requiring also a VAT number (“Partita IVA”). Furthermore, the Draft Law proposes a public register listing all properties subject to short-term rental period and property identification code.
